ÖNORM B 2110 contains in chapters 5 to 12, the general contract terms for construction works and is present in the issue of 15th March 2013. It forms the basis for general contractual provisions of many public and private principals of different sizes. ÖNORM B 2110 contains generally worded treaty provisions. The circumstances of performance should therefore be considered in each specific provisions of the construction contract. Nevertheless, it is necessary to provide changes even in general provisions to avoid conflicts due the construction. Due to the large scope of topics to be treated, the thesis deals only with most important part of ÖNORM B 2110, the section 7, which is approaching the deviations of performance and its consequences. In the main chapters (Chapters 2-6) by using the comments of renowned authors clauses are determined, which are causing discussions because of their differences in the interpretation. Comparisons are also led to prevailing legal norms, to which the ÖNORM has an enormous offset in various points. At the points where a corresponding case law exists, these are also used to explain the determination. The disclosed opinions on the clauses are included in the proposed wording for the contract in the final section (Chapter 7). By formulating proposals should be ensured that the differences of opinion are cleared up and the discussions during construction can be reduced on an acceptable level. Thus, also to ensure that any impact on the performance is avoided due to the conflicts between the contracting parties.
